According to Decree of the Government of the Russian Federation No. 1368 of August 22, 2023, purchases of medical devices and medical nutrition products are allowed for specific trade names, without taking into account possible equivalents, when they are required by patients for medical reasons.
To include a device in the list, it is necessary to submit an application to the Ministry of Health from the medical organization providing care to the patient, or from regional health authorities and their main freelance specialists.
The application will be considered by a commission of representatives of the Ministry of Health, the Ministry of Industry and Trade, the FAS, Roszdravnadzor and Rospotrebnadzor within fifteen days. In this case, the consideration period may be extended by another fifteen days. Also, for the purchase, the conclusion of the chief freelance specialist of the Ministry of Health on the disease is required.
Another condition: the medical device must be registered in the Russian Federation, and the medical nutrition must be intended for patients with rare diseases.
Thus, the purchase of the necessary items can be carried out immediately in large quantities. In addition to simplifying the public procurement procedure, the new measure will ensure the uninterrupted supply of all those in need with the necessary medical products and food. Previously, purchases were made only for one patient and only for the duration of treatment.
